These Terms and Conditions (“Terms”) govern your access to and use of Maker Mockup at makermockup.com, including its online mockup editor, design tools, exports, saved projects, and paid plans (collectively, the “Service”). “Maker Mockup,” “we,” “us,” and “our” refer to the operator of the Service. By using the Service or purchasing a plan, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and your account
You must be legally able to enter into a binding agreement in your place of residence. If you create an account, provide accurate information, keep your sign-in credentials secure, and promptly tell us about unauthorized access. You are responsible for activity under your account. Contact us if you believe your account has been compromised.
2. Plans, billing, and cancellation
Available plans, features, prices, billing intervals, and applicable taxes are shown on the Plans page and at checkout before you confirm a purchase. Prices are displayed in U.S. dollars unless stated otherwise. An annual plan is charged for its full annual term; a monthly plan is charged monthly. Where a plan renews automatically, you authorize the applicable recurring charge until you cancel.
You may cancel a subscription at any time using the cancellation method made available in your account or by contacting [email protected]. Unless applicable law or our Refund Policy requires otherwise, cancellation stops the next renewal and your paid access continues until the end of the current billing term. Cancellation does not by itself refund a charge already made.
We will provide required notices and obtain any consent required by applicable law before changing recurring prices or material billing terms. A price change will not retroactively alter a completed charge.
3. Service features and availability
Plan features may include watermark-free exports, commercial use of exported mockup images, specified export resolutions, saved projects, and priority or batch processing. The exact features included in each plan are those stated at the time of purchase. Features can depend on device, browser, file format, or mockup compatibility. We may update or improve the Service, but we will not intentionally remove a material paid feature during a current paid term without providing an appropriate remedy where required by law.
We work to keep the Service available and secure, but do not promise uninterrupted or error-free operation. Temporary maintenance, network issues, third-party services, or events outside our reasonable control may affect availability. This paragraph does not limit remedies available under mandatory consumer law.
4. Your designs and content
You retain ownership of designs, logos, images, and other material you upload (“Your Content”). You grant us a limited, non-exclusive license to host, process, reproduce, and transmit Your Content only as reasonably necessary to operate, secure, support, and provide the Service to you. We do not claim ownership of Your Content.
You confirm that you have the rights and permissions needed to upload and use Your Content. Do not upload or use content that infringes another person’s rights, violates law, or contains malware or harmful code. You are responsible for maintaining copies of your original files and exports.
5. Mockups and commercial use
Subject to the plan you purchased and applicable third-party rights, you may use exported images that you create with the Service for personal or commercial presentations, marketing, portfolios, and client work. This permission covers the exported image—not the underlying mockup file, source assets, templates, software, or third-party trademarks. You may not redistribute, resell, sublicense, or provide underlying mockup files or assets as standalone files or editable templates.
You remain responsible for the content of your design and for confirming that your intended use of an export is lawful. Nothing in these Terms transfers ownership of Maker Mockup materials or third-party rights to you.
6. Acceptable use
You may not misuse the Service, bypass access or security controls, interfere with its operation, probe or reverse engineer it except where such restriction is prohibited by law, use it to distribute unlawful or harmful material, or use automated activity in a way that places an unreasonable burden on the Service. We may investigate suspected abuse and restrict or suspend access when reasonably necessary to protect users, the Service, or third-party rights. We will act consistently with applicable law.
7. Payments and refunds
Payments are handled through the payment method and provider presented at checkout. We do not ask you to send full payment-card details by email. Refund eligibility and the advertised 14-day money-back guarantee are explained in our Refund Policy. Nothing in these Terms excludes a refund, cancellation, or other right that cannot lawfully be excluded.
8. Suspension and termination
You may stop using the Service and cancel a subscription as described above. We may suspend or end access for a serious or repeated breach, suspected fraud, security risk, or legal requirement. Where reasonably possible, we will provide notice and an opportunity to address the issue. Any rights or obligations that by their nature should continue after termination will remain in effect.
9. Disclaimers and liability
The Service is provided with reasonable care. To the extent permitted by law, we do not guarantee that every mockup, uploaded file, browser, or device combination will work identically or that every export will meet a particular production or printing specification. You should review exports before relying on them.
Nothing in these Terms excludes or limits liability, consumer rights, or remedies that cannot be excluded or limited under applicable law. Where the law permits a limitation, Maker Mockup will not be liable for indirect or consequential loss arising from use of the Service; this does not limit liability for fraud, intentional misconduct, or any other liability that cannot legally be limited.
10. Changes to these Terms
We may update these Terms to reflect changes to the Service or legal requirements. We will post the revised Terms here and update the effective date. If a change materially affects an active subscription or your rights, we will provide any notice required by law. Continued use after the effective date means the revised Terms apply to future use, subject to mandatory legal rights.
11. Governing law and consumer rights
These Terms are subject to the laws applicable to the transaction and the parties, without depriving consumers of mandatory protections available in their country or place of residence. Any dispute will be handled by the competent forum determined under applicable law. Nothing in this section waives a consumer’s non-waivable rights.
